Terms & Conditions

Last Updated: 10 April 2025  ·  Nakhon Advocates  ·  Nakhon Ratchasima, Thailand

These Terms and Conditions govern the relationship between Nakhon Advocates ("the practice", "we", "our") and any person ("you", "the client") who engages our legal services or makes use of our website. By contacting us, submitting a form, or proceeding with an engagement, you confirm that you have read these terms and accept them. If any part of these terms is unclear to you, we welcome questions before any engagement begins.

1. About the Practice

Nakhon Advocates is a legal practice based in Nakhon Ratchasima, Thailand, providing advisory and representational services in matters of Thai inheritance and estate law. Our address is 41 Chom Phon Road, Nai Mueang, Mueang Nakhon Ratchasima, Nakhon Ratchasima 30000. Enquiries may be directed to [email protected] or by telephone to +66 44 268 9135.

2. Scope of Services

Nakhon Advocates provides legal services in the following areas, which are described more fully in the service engagement documentation presented to each client at the outset of their matter:

  • Probate Eligibility Review — A written advisory note on whether and how to open probate proceedings in Thailand, including analysis of domicile, property situs, and testamentary documents (฿1,900).
  • Heir Dispute Representation — Full representation in inter-heir disputes, including pleadings, evidence preparation, and hearing advocacy (฿9,100).
  • Comprehensive Estate Litigation — Multi-stage representation through all phases of complex estate litigation before the Thai courts, including any appeal (฿10,700).

Services are provided only after a formal engagement letter has been signed by both parties. Nothing on our website constitutes legal advice, and no adviser–client relationship arises from the mere submission of a web form or initial enquiry.

3. Fees and Payment

The fees set out on our website represent the base fee for each service as described. They are denominated in Thai Baht (฿) and are subject to VAT where applicable under Thai law.

Following an initial consultation, a formal fee estimate will be provided in writing. Where matters are more complex than initially apparent — for instance where additional hearings, appeals, or translation work are required — revised fee proposals will be discussed with you before any additional work is undertaken.

Payment terms are set out in the engagement letter. We accept bank transfer and other methods agreed in writing. We do not accept payment in cash for amounts exceeding ฿1,000 in order to comply with applicable anti-money-laundering obligations.

4. Client Responsibilities

You agree to provide us with accurate, complete, and timely information as reasonably requested throughout the course of your matter. Where the information you provide is incomplete or misleading, we are not responsible for any adverse outcome that results.

You also agree to keep us informed of any change in your contact details or circumstances that may be relevant to your matter, and to respond to our correspondence within a reasonable time. We will always communicate with you in a manner and at a pace respectful of the personal weight of inheritance proceedings.

5. Confidentiality

We are bound by the professional confidentiality obligations applicable to legal practitioners in Thailand. All information you share with us in the course of an engagement is held in strict confidence and will not be disclosed to third parties except:

  • where required or permitted by law or a court order;
  • where disclosure is necessary to carry out your instructions (for example, filing documents with a court);
  • with your express written consent.

6. Conflict of Interest

Before accepting any engagement, we conduct a conflict-of-interest check. If a conflict is identified, we will inform you promptly and, where appropriate, refer you to another suitable practice. In matters involving multiple heirs, we may represent only one party or group and will be clear about this at the outset.

7. Limitation of Liability

We exercise reasonable professional care in all matters we handle. However, legal proceedings before the Thai courts involve outcomes that cannot be assured, and we make no representation about the result of any proceeding.

To the fullest extent permitted by Thai law, our liability to you in connection with any engagement is limited to the fees actually paid to us for that specific matter. We are not liable for indirect, consequential, or incidental losses.

Nothing in these terms limits our liability for fraud, wilful misconduct, or any liability that cannot lawfully be limited.

8. Termination of Engagement

Either party may end an engagement by giving reasonable written notice. If you choose to terminate, you remain liable for fees for work completed up to the date of termination. We will return any documents belonging to you promptly upon receipt of any outstanding fees.

We may terminate an engagement if you act in a way that prevents us from carrying out our duties properly, if a conflict of interest arises that cannot be resolved, or if we are required to do so by law.

9. Intellectual Property

All documents, precedents, written opinions, and other materials produced by Nakhon Advocates in the course of an engagement are the intellectual property of the practice until fees for that matter have been paid in full. Upon full payment, you receive a licence to use those materials for the purpose for which they were produced. You may not reproduce or distribute our materials for commercial purposes without prior written consent.
