The Challenge

A family came to us six weeks after the death of their father, unsure whether probate was required for a rural plot of land he had farmed for thirty years but never formally registered in his name. Other advisers had given conflicting opinions.

Our Approach

We reviewed the land documents, confirmed the situation with the local district office, and examined whether the land fell under the category of possessory rights rather than formal title. The review took three weeks.

Outcome

The written advisory note confirmed that a modified form of probate was appropriate and set out a clear recommended process. The family was able to proceed with confidence, having been charged only the stated review fee of ฿1,900.

A Disputed Will Resolved Through Heir Representation

The Challenge

Three adult children disputed the terms of a will made by their mother, which appeared to have been executed at a time when witnesses later indicated her capacity was unclear. A fourth child was the sole beneficiary under the disputed instrument.

Our Approach

We represented the three disputing heirs, obtained medical records from the relevant period, prepared witness statements, and argued the matter through to judgment at first instance. Duration: eleven months.

Outcome

The court accepted that the will did not meet the formal requirements under the Civil and Commercial Code and ordered that the estate be distributed according to statutory succession. The judgment was not appealed by the opposing party.

Multi-Year Estate Litigation with Appeal

The Challenge

A commercial property in Nakhon Ratchasima was the subject of a dispute between two branches of a family following the death of the original owner without a will. The estate involved a registered title, a business lease, and outstanding debts.

Our Approach

We handled all stages from initial pleadings through trial and a subsequent appeal. The engagement lasted twenty-two months in total, with the same senior advocate leading throughout. The opposing family engaged Bangkok-based representation.

Outcome

The Court of Appeal upheld the first instance judgment in our client's favour on the principal disputed point, resulting in a clear determination of heirship and enabling the estate administration to proceed. The commercial property was subsequently partitioned by agreement.
